DMCA Notice & Takedown Procedure

RateMyDesigner respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), we respond promptly to notices of alleged copyright infringement. If you believe that content on our platform infringes your copyright, please follow the procedure below.

How to File a Takedown Notice

To be effective under the DMCA, your written notice must include all six of the following elements:

    A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

  2. 2

    Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved).

  3. 3

    Identification of the material that you claim is infringing and its specific location on our site (provide the exact URL or URLs).

  4. 4

    Your contact information, including your full name, mailing address, telephone number, and email address.

  5. 5

    A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

  6. 6

    A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

To file a DMCA notice or counter-notice, send the complete notice (with all six elements listed above under "How to File a Takedown Notice") to dmca@prodxlabs.com. Notices missing required elements may not be considered effective. Misrepresentations in a takedown notice can subject the sender to liability for damages under 17 U.S.C. § 512(f).

Counter-Notice Procedure

If you believe that content you submitted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice. A valid counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed as a result of a mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal district court for your judicial district, and that you will accept service of process from the person who provided the original takedown notice.

Send counter-notices to the same designated agent email above. Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file an action in court within 10-14 business days, we may restore the removed material at our discretion.

Repeat Infringer Policy

In appropriate circumstances and at our discretion, RateMyDesigner will terminate the accounts of users who are repeat infringers of copyright or other intellectual property rights.
